ZorgSocial Beta Terms

These terms apply to optional pre-release features and services made available for evaluation before general commercial release.

Last updated: 8 November 2026

These Beta Terms ("Beta Terms") govern your access to and use of any ZorgSocial service, feature, tool, or functionality that we identify as beta, preview, early access, experimental, or pre-release (each, a "Beta Service"). They supplement the applicable ZorgSocial terms of service or enterprise agreement (the "Agreement"). By enabling or using a Beta Service, you agree to these Beta Terms. If you do not agree, do not enable or use the Beta Service.

1. Optional evaluation access

Beta Services are offered solely for optional evaluation, testing, and feedback before possible general release. They are not a commitment to provide any feature or service commercially, and ZorgSocial may decide not to release, maintain, or support any Beta Service.

  • Access may be limited to selected users, workspaces, devices, or periods and may require additional instructions or eligibility conditions.
  • You are responsible for ensuring that each person using a Beta Service is authorized and complies with these Beta Terms and the Agreement.

2. Experimental features and changing functionality

Beta Services are under development and may be modified, suspended, restricted, or discontinued at any time, with or without notice. Features, interfaces, integrations, documentation, and results may change without preserving prior functionality or settings.

Beta Services may contain bugs, defects, omissions, interruptions, security weaknesses, compatibility problems, or other errors. They may not work as intended, may not be available continuously, and may not interoperate with your systems, accounts, or other services.

3. No production or critical use

Use Beta Services only for evaluation in a non-production environment. Do not use or rely on them for emergency response, safety-critical operations, medical or legal decisions, financial decisions, regulated activity, or any other use where failure, delay, or inaccuracy could cause harm or material loss.

You are responsible for maintaining separate backups of your data, validating compatibility, and protecting your systems and accounts. Do not submit sensitive, health, biometric, payment-card, government-identification, children's, or other specially regulated data to a Beta Service unless ZorgSocial expressly approves that use in writing.

4. Accuracy, verification, and no responsibility for beta issues

Beta Service outputs, recommendations, analytics, generated content, and other information may be incomplete, incorrect, outdated, misleading, or unsuitable for your needs. They are provided for evaluation only and are not professional, legal, financial, medical, or other advice.

You must independently review and verify all information and outputs before relying on them, sharing them, publishing them, or taking action. You are solely responsible for decisions and actions taken based on a Beta Service, for the use of its outputs, and for any consequences to you, your users, or third parties.

To the fullest extent permitted by applicable law, ZorgSocial has no responsibility or liability for any issue, defect, failure, error, omission, inaccuracy, interruption, incompatibility, loss, or damage arising from or relating to a Beta Service, including any decision, content, output, or action based on or produced through a Beta Service.

5. Disclaimer of warranties and support

Beta Services are provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by applicable law, ZorgSocial and its affiliates disclaim all express, implied, and statutory warranties and conditions, including any warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement, quiet enjoyment, or error-free or secure operation.

ZorgSocial does not promise that a Beta Service will be uninterrupted, secure, corrected, supported, compatible, or available for any minimum period. Beta Services are not covered by any service-level commitment or support obligation unless ZorgSocial expressly agrees otherwise in writing.

6. Customer data and privacy

Your use of a Beta Service does not change the data rights or privacy obligations in the Agreement, Privacy Policy, or any applicable data processing addendum. You must have all rights, notices, permissions, and legal bases required for data you or your users submit.

ZorgSocial may remove or delete Beta Service data when the Beta Service is changed, discontinued, or access ends. You are responsible for exporting or backing up data you need before using a Beta Service and before access ends.

7. Confidentiality and restrictions

Unless ZorgSocial has publicly announced the Beta Service, you must treat its non-public features, performance, documentation, and related materials as ZorgSocial's confidential information. You may disclose them only to your authorized users who need access and are bound by confidentiality obligations at least as protective as these terms.

You must not publish benchmark results, reviews, screenshots, or other evaluations of a Beta Service, or disclose its availability, without ZorgSocial's prior written consent. You must not reverse engineer, interfere with, probe, or perform security testing on a Beta Service except as expressly authorized in writing.

8. Intellectual property and feedback

ZorgSocial and its licensors retain all rights in Beta Services, including all related software, technology, designs, documentation, and improvements. These Beta Terms grant you only a limited, revocable, non-transferable right to use a Beta Service for the permitted evaluation purpose.

If you provide suggestions, ideas, or feedback, you grant ZorgSocial a worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use and incorporate that feedback without restriction or compensation. This feedback license does not transfer ownership of your Customer Content, which remains governed by the Agreement.

9. Fees, suspension, and discontinuation

Any fees for a Beta Service will be stated in the applicable offer or Agreement. Unless expressly stated in writing, enabling or using a Beta Service does not change the fees, renewal terms, or other conditions of your existing Services.

ZorgSocial may suspend or terminate access to any Beta Service at any time, with or without cause or notice. You may stop using a Beta Service at any time. When access ends, your right to use it ends immediately, and ZorgSocial has no obligation to provide a replacement, migration, continued access, or general-release version.

10. Limitation of liability

To the fullest extent permitted by applicable law, the ZorgSocial Parties will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive loss or damage, or for loss of profits, revenue, business opportunity, goodwill, data, use, or anticipated savings, arising out of or relating to a Beta Service, even if advised of the possibility of such loss.

To the fullest extent permitted by applicable law, the disclaimers and liability limitations in the Agreement apply to all Beta Services and are not increased by these Beta Terms. Nothing in these Beta Terms excludes or limits liability that cannot lawfully be excluded or limited.

11. Order of precedence and continuing effect

If these Beta Terms conflict with the Agreement, these Beta Terms control only for the Beta Service and only to the extent of the conflict; the Agreement controls all other matters. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

The provisions concerning disclaimers, customer responsibility, confidentiality, intellectual property, and liability continue to apply after access to a Beta Service ends.

These Beta Terms supplement the ZorgSocial Terms of Service.
